Florida Marriage Licenses

Florida Statute 741.01 in part, states that the Clerk of Circuit Court acts as an agent for the State of Florida for issuing Marriage Licenses. Links to several of the local Clerks are included below.

• Waiting Period:
  • Non-Residents: There is no waiting period for non-residents.  You do not need to be a Florida resident to obtain a marriage license, but you must have a Florida marriage license to be married in Florida.Witnesses: There is no requirement to have witnesses in Florida, however, you may select two to sign the license.
  • Residents: There is a mandatory three day waiting period for residents, meaning if residents apply on the 1st, they can't marry until the 4th. Bring your license to the ceremony with you.  Your officiant is responsible for mailing it back to to the clerk after the ceremony.
• Residency Requirement: Non-residents may marry in Florida, but must obtain a Florida license to have their wedding recognized legally.
• Submission to the Cleri:Bring your license to the ceremony with you.  Your officiant is responsible for mailing it back to to the clerk after the ceremony.
